The firm’s Bankruptcy, Restructuring, and Creditors’ Rights Practice Group has extensive experience in serving as general and special counsel to bankruptcy trustees in both Chapter 7 and Chapter 11 proceedings, as well as plan trustees. Our work for trustees includes all types of adversary proceedings; Chapter 5 recovery actions; objections to claims; retention issues; and all types of asset recovery. We have experience in preparing Chapter 11 plans and disclosure statements for trustees, together with advice on the Chapter 11 trustee's operation of the debtor's business. Our attorneys are familiar with the legal and business issues that trustees frequently encounter.
We also represent receivers, financial advisors, auctioneers, the trustees of liquidating trusts, and other insolvency professionals. We routinely obtain the appointment of professionals, represent them during the proceedings, prepare fee applications, resolve disputes regarding the payment of their fees, and negotiate litigation and liquidating trust agreements on their behalf.
Tom Waldrep is a former U.S. Bankruptcy Judge who represents several Chapter 7 bankruptcy trustees and has served as a federal equity receiver. Charles Summerall has served as a Chapter 11 bankruptcy trustee. Jeff Tarkenton is a former Chapter 7 trustee and represents Chapter 7 and Chapter 11 trustees.
